THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P. NAVEEN RAO PUBLIC INTEREST LITIGATION No.257 of 2014 PC: (per the Hon'ble The Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

The petitioners in the instant petition seek the following relief:

"For the reasons stated in the accompanied affidavit, it is therefore humbly prayed that this Honourable Court may be pleased to issue a Writ or Writs more appropriately a Writ of Mandamus declaring the resolution passed by the 2nd and 3rd respondents agenda item No.7 dated : 31.07.2014 shifting the Vegetable Market from Devarakota to Gandhi Park and giving it name as Gandhi Vegetable Market situated at Nirmal Town, Adilabad District is illegal, void and ultra virus in the interest of justice and equity or to pass such other order or orders as deem fit and proper in the circumstances of the case."

Learned counsel for respondents 2 and 3, on instructions, submits that respondents 2 and 3 do not propose to shift the vegetable market from Devarakota to Gandhi Park as alleged and as stated in the petition. His statement is recorded and accepted.

In view thereof, learned counsel for the petitioners does not press this PIL.

PIL is disposed of as not pressed.

Consequently, miscellaneous petitions, if any, also

stand disposed of.
