Aggrieved by the action of the official respondents in interfering with the possession of the petitioners, the present writ petition is filed.
It is the case of the petitioners that they are in possession of the subject lands and the authorities, without issuing any notice to them, are trying to dispossess them from the subject lands. The learned Counsel for the petitioners had drawn the attention of this Court to the letter addressed by the then M.R.O., Chandrugonda to the Revenue Divisional Officer, Kothagudem, vide Rc.No.B/2731/97, dated 17.11.1997 wherein the petitioners' names are shown to be in possession of the subject lands along with others.
Learned Government Pleader, on instructions, states that the petitioners are in possession and occupation of the Gramakantam land and without obtaining any permission from the competent authority, they are making constructions unauthorisedly. Learned Government Pleader has also stated that taking advantage of the letter written by the then M.R.O. to the R.D.O., vide Rc.No.B/2731/97, dated 17.11.1997, the petitioners are trying to grab some more government land. However, learned Government Pleader fairly submits that the petitioners are in possession of the subject lands, which is a Gram Khantam land and they will take necessary steps to evict the petitioners from the unauthorised possession of the government land duly following the procedure contemplated under the relevant Act/Acts.
WP No.11388 of 2020 AAR, J In view of the above submission, the writ petition is disposed of with a direction to the official respondents not to interfere with the possession of the petitioners over the subject land. However, it is made clear that this Order does not preclude the official respondents from taking necessary action to evict the petitioners in accordance with the procedure prescribed by law. It is also made clear that the petitioners shall not make any construction and change the nature of the land except using it for agricultural purposes.
The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________ A.ABHISHEK REDDY, J Date : 29.07.2020.
