HON'BLE SRI JUSTICE J. SREENIVAS RAO WRIT PETITION No.11472 of 2020 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare.

2. This writ petition is filed seeking writ of mandamus declaring the orders passed by the respondent No.1 in Memo No.554/TW.LTR/2020, dated 14.07.2020 rejecting the stay application while admitting the revision petition filed by the petitioner as illegal and arbitrary.

3. Learned counsel for the petitioner contended that the petitioner filed revision petition before the respondent No.1 aggrieved by the order passed by the respondent No.6 in CMA No.27 of 2016 dated 24.03.2020 confirming the order passed by respondent No.2 in LTR Case No.2/2014/Kmpl dated 07.05.2016 in respect of land admeasuring to an extent of Ac.4.08 guntas in Survey No.543/అ, situated at Mucharla village, Kamepalli Mandal, Khammam District.

4. He further submits that respondent No.1 while admitting the revision petition rejected the stay petition without giving any opportunity to the petitioner and passed impugned Memo No.554/TW.LTR/2020, dated 14.07.2020. By

virtue of the rejection of the stay, the respondent No.3 is trying to take steps to vacate the petitioner from the subject land. This court on 05.08.2020, granted interim order and the same is continuing till date.

Without going into the merits of the case, this writ petition is disposed of directing respondent No.1 to dispose of the revision petition filed by the petitioner within a period of four (4) months from the date of receipt of the copy of this order after giving opportunity to the petitioner as well as respondents in the revision petition in accordance with law, if not already disposed. Till such time the interim order granted by this Court on 05.08.2020 shall continue. No costs.
