This Writ Petition is filed challenging the decision dated 17.02.2018 of the Joint Collector, Jogulamba Gadwal, on a revision preferred by the 5th respondent, who is a purchaser from respondents 6 and 7.

Counter affidavit is filed by the 5th respondent. Reply affidavit is also filed by the petitioner.

Learned counsel for the parties made extensive submissions on the respective claims on the issue. However, having regard to the defects pointed out in conducting proceedings by the authorities, learned counsel for the parties agree to remand the matter to the Joint Collector, Jogulamba Gadwal District, to consider the revision filed by the 5th respondent afresh on merits after duly taking note of the respective contentions. 5.

Having regard to these submissions, the Court has not recorded the detailed submissions made by learned counsel for the parties.

The Writ Petition is accordingly allowed. The order of the Joint Collector, dated 17.02.2018, is set aside and the matter is remanded to the Joint Collector, Jogulamba Gadwal District, for consideration of the revision afresh. The revision petitioner and the respondents before the Joint Collector are entitled to file the

documents and the additional pleadings, if they desire, within a period of two weeks from the date of receipt of a copy of this order. If no additional pleadings and/or documents are filed by the respective parties within the time granted, it is deemed that the parties have no additional material or pleadings to be filed and the Joint Collector shall proceed as per the original material placed on record by the concerned parties. After receiving the respective additional pleadings and the documents, if any, within the time fixed above or after expiry of time granted to the parties, as the case may be, the Joint Collector shall fix a date for hearing in advance and intimate the same to the parties for their appearance. The parties or their counsel shall appear on the date fixed by the Joint Collector and make their submissions.

After due consideration of the respective submissions, the Joint Collector shall pass order by assigning due reasons in support of his decision. The entire exercise shall be completed within a period of two months. There shall be no order as to costs. Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
