Res pondenUCom pla ina nt Petition under Section 438 of Cr P.C, praying that in the circumstances stated in the Criminal Petition, the High Court may be pleased to direct the respondent to enlarge the petitioners/Accused No.1 to 4 on Anticipatory Bail in the event of petitioners' anest in F.l.R.No, 220 OF 2021 daled 17/0412021 on the file of S.H.O., Subedari P.S., Warangal District for an offences under Sec.3 and 4 of The Telangana Gaming Act, 1974 on such terms and conditions as this Hon'ble court dee and proper in the interest of Justice.
The petition coming on for hearing, upon perusing the Petitton and the grounds filed in support thereof and upon hearing the arguments of Sri RAVI KUMAR VADLAKONDA, Advocate for the Petitioners, Asst. PUBLIC PROSECUTOR for the Respondent, the Court made the following.

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners / Accused Nos. I to 4 seeking to grant anticipatory bail in the event of their arrest in connection with Crime No.22O of 2021 of Subedari Police Station, Warangal District, which was registered for the offences punishable under Sections 3 and 4 of the Telangana Gaming Act, t97 4.

Heard learned counsel appearing for the petitioners, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioners would submit that the petitioners are innocent of the offences alleged against them; that the petitioners never played the cards in the premises of the association as alleged in the complaint; that in order to implicate the petitioners, a false case has been filed against them and ultimately prayed this Court to grant anticipatory bail to the petitioners.

Learned Assistant Public Prosecutor opposed to grant I anticipatory bail to the petitioners.

Thus looking into the nature of allegations levelled against the petitioners/Accused Nos.l to 4 and having regard to the other facts and circumstances of the case and also pandamic situation, without advertising into the merits of the case, I am
inclined to grant anticipatory bail to the petitioners/Accused Nos.1 to 4.

Accordingly, the Criminal Petition is allowed and the petitioners / accused Nos.l to 4 are granted anticipatory bail subject to the following terms and conditions: (1) The petitioners/ accused Nos. 1 to 4 are directed to surrender before the Station House Officer, Subedari Police Station, Warangal District, within a period of four
(04) weeks from the date of this order and on such surrender, the said Station House Officer shall release them on bail on their executing a personal bond to the tune of Rs.10,000/- (Rupees Ten thousand only) each with two sureties lor a like sum each to the satisfaction of the said Station House Offlcer.
(2) The petitioners / accused Nos.1 to 4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
