THE HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO SECOND APPEAL No.495 of 2014 JUDGMENT :

Learned counsel for the appellant filed a letter, dated 27.03.2019, in the registry, seeking permission of this Court to withdraw the second appeal.

Permission as sought for is accorded. Admittedly, pursuant to the trial Court's decree, the appellant/plaintiff stated deposited Rs.1,40,000/- amount, which is lying before the trial Court in Civil Court deposit invested, if any, in any Bank in F.D.R. or the like, and thereby the same can be permitted to withdraw by filing a cheque petition.

Accordingly, the second appeal is dismissed as withdrawn. Miscellaneous petitions pending, if any, shall stand closed. No costs.
