HONOURABLE SRI JUSTICE P. NAVEEN RAO ORAL ORDER:

The petitioner submitted building permission application dated 10.7.2013 which was returned vide endorsement dated 19.7.2013 stating that petitioner should submit relevant documents in proof of ownership in lieu of claim of the site by Sri Venkateswara Swamyvari Devasthanam, Allipuram. Challenging the endorsement dated 19.7.2013, W.P. No. 32327 of 2014 is instituted in this Court, however, same is subsequently withdrawn. According to the petitioner, in compliance of the objection in endorsement dated 19.7.2013, petitioner submitted representation dated 30.4.2015 enclosing all the relevant documents as required and requesting to process his application dated 10.7.2013. This writ petition is instituted seeking a declaration that not approving the application of the petitioner dated 10.7.2013 for grant of building permission is illegal.

Heard the learned counsel for petitioner, learned Government Pleader for Municipal Administration and learned standing counsel for respondent corporation Sri Lakshminarayana Reddy.

Learned standing counsel for respondent corporation submits that since petitioner stated to have submitted a representation on 30.4.2015 enclosing all the relevant documents, respondents be directed to consider the same and pass appropriate orders.

Having regard to the same, without expression any opinion, writ petition is disposed of directing the second respondent to consider the representation of the petitioner dated 30.4.2015 and if the petitioner has complied with the objections raised vide endorsement dated 19.7.2013 to process the building permission application of the petitioner dated 10.7.2013.

However, if the respondent corporation is not satisfied, appropriate decision taken in accordance with law be communicated to the

petitioner. A decision as directed above be taken within a period of four weeks from the date of receipt of copy of this order. Subject to above direction, writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
