condition No.ii imposed upon petitioners-Accused Nos.2 to 4 in Crl.P.No.4074 of 2023 dated 28.04.2023 that "the petitioners - accused Nos.2 to 4 shall report before the Station House Officer, Malakpet Police Station, on every Monday between 10.30 AM and 12.00 PM till filing of final report".
Learned counsel for the petitioners has submitted that the petitioners were charged with offence under NDPS Act, even though the seized material was not prohibited drug. His further contention is that the petitioners are the dealers of pharmaceuticals and they have been regularly attending before the police station as per the directions of this Court dated 28.04.2023. Further he submitted that continuously attending before the concerned police station causing trouble to the petitioners.
The allegation against the petitioners is that without proper prescription they were supplied to the needy customers to get intoxicated. The bail was granted to the petitioners in the month of April, 2023 and the petitioners are attending before the police station
as of now as per the directions of this Court, nearly three months period is completed. In the said circumstances, further attendance of the petitioners before the police station is unwarranted.
Accordingly, this application is allowed and the condition of attendance imposed by this Court upon petitioners - accused Nos.2 to 4 in Crl.P.No.4074 of 2023 dated 28.04.2023, is dispensed with.
