HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26354 OF 2017 ORDER:

This writ petition is filed challenging the action of the third respondent in issuing proceedings dated 11.07.2017 prohibiting the petitioner from drawing the funds of the Gram Panchayat for a period of three months.

It is clear from the impugned order that a show cause notice was issued to the petitioner on 14.06.2017 and the petitioner, who is Sarpanch of the Gram Panchayat, submitted his explanation on 28.06.2017. Since the explanation was not satisfactory, the impugned order was passed on 11.07.2017 suspending the cheque drawing power of the petitioner for a period of three months. There is a provision for Appeal against the impugned order to the District Collector, second respondent. In view of the existence of the remedy of Appeal, it is open to the petitioner to take appropriate steps if the petitioner is so aggrieved by the impugned order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed.
