THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36939 OF 2013 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in maintaining History Sheet No.18, dated 5.1.1997, in Kothapatnam Police Station, Kothapatnam, Prakasam District against the petitioner as illegal and arbitrary and consequently, to set aside the same.

Case of the petitioner is that a History Sheet was opened against him in the year 1997 in Kothapatnam Police Station and the respondents are continuing the same without closing it; that as on today, no cases are pending against him; that in general, a History Sheet opened shall be continued and maintained only for a period of two years; that the History Sheet was opened against him on 5.1.1997 and the same is being continued for the last 17 years and 11 months, which amounts to violation of right to equality and right to freedom; that he has already made a representation, dated 29.8.2013, to the Superintendent of Police, Prakasam District in this regard, but no action is taken till date. 3.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, as the petitioner has already made a representation to the Superintendent of Police, Prakasam District on 29.8.2013, the Superintendent of Police, Prakasam District is hereby directed to dispose of the same in accordance with law as

expeditiously as possible, preferably, within a period of three (3) weeks from the date of receipt of a copy of this order. 5.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
