THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.17195 of 2013 ORDER:
Heard Sri P.Veera Reddy, learned Senior Counsel for petitioner, Sri S.S.Varma for National Highways Authority of India and the Assistant Government Pleader for Land Acquisition.
The petitioner prays for the following relief: "....to issue an appropriate writ, order or directions mostly one which is in the nature of a writ of mandamus, declaring the acquisition of property bearing door No.13-71-1, Opposite to APSRTC Bus stand, Panyam Village and Mandal, Kurnool District belonging to the petitioner by the respondents under Award No.03/2011 in RC.G1.1580/2009, dated 10.08.2011 of the 1st respondent as illegal, irregular, unconstitutional, unjustified and unsustainable and set aside the Award insofar as the petitioner is concerned and pass such other order or orders as deems fit ....." The issue raised in the writ petition is against nondisclosure of details against Sy.Nos.770/2 and 771/1 proposing to acquire an extent of Ac.0.15 cents and Ac.0.37 cents respectively for the road widening of Hyderabad to Bangalore road on N.H.7, in notification issued under National Highways Act.
Sri P.Veera Reddy for petitioner having regard to a few earlier orders on the very same objection, submits that those decisions are covered against the petitioner. The decisions referred to are M.Yella Reddy and another v. Government of India, rep. by its Deputy Secretary, Ministry of
Shipping, Roads, Transport and Highways (Department of Road, Transport and Highways), New Delhi and others1" and the common order of this Court dated 11.07.2017 in W.P.No.9920 of 2017 and batch.
Statement is placed on record.
The Writ Petition is dismissed accordingly. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
