HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26532 of 2016 ORDER:

1 This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the first respondent in disposing of the revision petition dated 25.06.2016 filed by the petitioner under Section 264 of the A.P. Panchayat Raj Act, 1964 as irregular and arbitrary.

2 Heard the learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj and Rural Development. 3 A perusal of the record reveals that the petitioner filed W.P.No.19478 of challenging the proceedings No.R.O.C.No.5816/2015/A1, dated 09.06.2016 issued by the second respondent. This Court, on 21.06.2016 while passing orders in W.P.M.P.No.23887 of 2016 in the said Writ Petition observed as follows: "Hence, the petition is dismissed. However, refusal of interim suspension by this Court does not preclude the petitioner from approaching the authority, who has power of revision, against the orders passed under Section 249 (6) of the Panchayat Raj Act. If the petitioner chooses to file a revision, the revisional authority may decide the same uninfluenced by any of the observations made in this petition in refusing grant of interim suspension."

4 In pursuance of the above said order, the petitioner filed revision petition before the first respondent.

5 The only relief sought by the petitioner in this Writ Petition is to direct the first respondent to dispose of the revision petition filed by him. The learned Assistant Government Pleader also consented for the same and requested this Court to direct the first respondent to dispose of the revision petition filed by the petitioner.

6 Having regard to the facts and circumstances of the case and in view of the submissions made by the counsel for both parties, the first respondent is hereby directed to dispose of the revision petition filed by the petitioner as expeditiously as possible, preferably, within twenty days from the date of receipt of a copy of this order. 7 With the above direction, this Writ Petition is disposed of. No order

as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
