HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10179 of 2019 ORDER:
The petitioner assails the inaction of the Tahsildar, Bibinagar Mandal, Yadadri-Bhongir District, respondent No.4, upon her representation dated 02.8.2018, whereby she requested him not to issue pattadar pass books in relation to the lands claimed by her. She also sought for a consequential direction restraining the respondents from interfering with her right of succession contrary to the interim order dated 02.02.2009 passed in A.S.No.26 of 2009 on the file of this Court.
Perusal of the record demonstrates that the petitioner was put on notice by respondent No.4 on 02.8.2018 that respondent No.6, Tummala Narendra Reddy, had sought mutation in his favour in relation to certain lands and for issuance of pattadar pass books. The petitioner admittedly responded to this notice and submitted her objections. The pattadar pahani copies filed by her however do not indicate the name of respondent No.6 having been recorded. The names that do appear in those pahanies do not find mention in the cause title of this Writ Petition.
Further, there is no indication of respondent No.4 having passed any final order pursuant to the notice dated 02.8.2018 and the objections submitted thereon by the petitioner. In the event any such order is passed by respondent No.4 under Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, the
SK, J WP.No.10179 of 2019 Dt:03.6.2019 petitioner is provided a statutory appellate remedy under Section 5
(5) thereof.
This Court therefore finds no grounds to entertain the matter as the Writ Petition seems to be based on a mere apprehension and no cause of action has crystallised as yet. On this short ground, the Writ Petition is dismissed. This order shall however not preclude the petitioner from taking recourse to appropriate remedies available to her as and when a cause of action arises.
Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
