HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23017 OF 2016 ORDER:

This writ petition is filed challenging the proceedings dated 15.06.2016 issued by the 4th respondent vide Memo No.1345/2015 wherein it is stated that the petitioner cannot be paid the exgratia amount in respect of the land admeasuring Ac.4-13 guntas in Sy.No.264, Kurmidda Village, Yacharam Mandal, Ranga Redy District because of pendency of the civil suit in the Court. Learned counsel for the petitioner submits that the subject land is the land assigned to the petitioner which has nothing to do with the partition suit filed by other brothers. He also submits that the proceedings dated 16.04.2016 goes to show that the subject land is the land assigned to the petitioner and the same is not disputed by the respondents.

He further submits that there is no injunction operating against the respondents for payment of compensation to the petitioner in respect of the subject land. Heard the learned Assistant Government Pleader for Revenue. In view of the above facts and circumstances, the impugned order dated 15.06.2016 is set aside and the 4th respondent is directed to take appropriate action for payment of compensation to the petitioner if there is no injunction operating against them. With the above direction, this writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.
