HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18348 OF 2011 ORDER:

This writ petition is filed declaring the action of the respondents in putting up the locks to the residential houses of the petitioners bearing Door.Nos.1-108/1, 1-85/1, 1-176 and 2-74 respectively situated in NN Patnam Village, Rowthulupudi Mandal, East Godavari District, as illegal and arbitrary and for a consequential direction to remove the seals and locks forthwith so as to enable the petitioners to reside in the said houses. Counter affidavit is filed by the 3rd respondent stating that the petitioners' wives and relatives misappropriated the amount of Rs.11,65,672/- and denied to reimburse the said amount. It is also stated that the petitioners have not given any explanation to the notices issued by the authorities.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. Counter affidavit filed by the 3rd respondent does not show that any proceedings under the A.P. Revenue Recovery Act have been initiated against the petitioners.

It is stated that in pursuance to the interim order passed by this Court on 30.06.2011, the seals and the locks put up to the residential houses of the petitioners have been removed. In view of above facts and circumstances, this writ petition is disposed of granting liberty to the respondents to initiate action under the A.P. Revenue Recovery Act for fixing the liability, after issuing notices. If any such notices are already issued to the

petitioners, it is open for them to file objections to the same if any. No costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 20-10-2016 dv
