THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY TR.C.M.P.NO.529 OF 2015 O R D E R:

This Transfer C.M.P. is filed by the petitioner-wife against the respondent-husband for transfer of O.P.No.11 of 2014 from the file of Senior Civil Judge, Kandukur, Prakasam District, to the file of Senior Civil Judge, Nandikotkur, Kurnool District.

The case of the petitioner is that the respondent-husband filed O.P.No.11 of 2014 seeking divorce and the same is pending on the file of Senior Civil Judge, Kandukur. The marriage of the petitioner with the respondent was solemnized on 10.09.2011. Thereafter, the respondent started harassing the petitioner for additional dowry and necked her out of the house. It is stated that the petitioner is interested in leading marital life with the respondent and now she is living with her old aged mother and it is difficult to travel from Nandikotkur to Kandukur to defend her case in O.P.No.11 of 2014. Though notice is served to the respondent, there is no appearance for the respondent.

Heard the learned counsel for the petitioner. It is stated by the learned counsel for the petitioner that the petitioner is living with her old aged mother and she cannot travel from Nandikotkur to Kurnool District, as she has no male assistance. Since there is no representation on behalf of the respondent and having regard to the facts and circumstances of the case, O.P.No.11 of 2014 pending on the file of Senior Civil Judge, Kandukur, Prakasam District is transferred to the file of Senior Civil Judge, Nandikotkur, Kurnool District.

Accordingly, the Transfer C.M.P. is allowed. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs. _________________________ A.RAJASHEKEAR REDDY, J Dt.24.11.2015 TJS THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY TR.C.M.P.NO.529 OF 2015
