THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5231 OF 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a writ in the nature of a writ of mandamus or any other appropriate writ, direction, order or orders declaring the action of the 3rd and 4th respondents herein is not accepted the existing Community, Nativity and Date of Birth certificate (Agnikula Kshatriya) B.C-A, despite the petitioner has already submitted her original certificate vide R.Dis.No.
652/2000 dated 03-01-2000 by the then Mandal Revenue Officer, Vijayapuram Mandal, Chittoor District, as she was selected in the DSC-2014 for the post of SGT (Telugu) as wholly arbitrary, illegal and without jurisdiction and void and violated the principles of natural justice and affected the petitioner's rights guaranteed under article 14, 16 and 21 of the Constitution of India and consequently direct the respondents herein to accept the existing Community, Nativity and Date of Birth Certificate issued by the then MRO, Vijayapuram Mandal, in favour of the petitioner as she belongs to Agnikula Kshatirya community (B.C-A) as she was selected for the post of SGT (telugu) and pass such other and further order or orders as this Hon'ble Court may deems fit and proper in the circumstances of this case."
2. In view of the availability of alternative remedy before the Tribunal, this Court is not inclined to entertain the present writ petition.
3. Accordingly, Writ Petition is dismissed, with a liberty to the petitioner herein to approach the appropriate forum, if she is advised to do so.
4. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
