THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY A.S.M.P.No.3220 & 3221 of 2017 IN/AND APPEAL SUIT Nos.384 & 396 of 2014 COMMON JUDGMENT:

A.S.No.384 of 2014 is filed by the 2nd defendant, under Section 96 of CPC, assailing the decree and judgment dated 31.05.2014 in O.S.No.119 of 2009 on the file of the Court of the Senior Civil Judge, Mangalagiri, Guntur District, wherein and whereby the suit filed by the respondent/plaintiff for specific performance of agreement of sale, was decreed. A.S.No.396 of 2014 is filed by the 1st defendant, under Section 96 of CPC, assailing the decree and judgment dated 31.05.2014 in O.S.No.8 of 2012 on the file of the Court of the Senior Civil Judge, Mangalagiri, Guntur District, wherein and whereby the suit filed by the 1st respondent/plaintiff for cancellation of registered sale deed, was decreed. Parties in both the matters are common.

A.S.M.P.No.3220 of 2017 and ASMP No.3221 of 2017 are filed to permit the petitioner to compromise the matter with the respondent in terms of the Memorandum of compromise. Petitioner/appellant and the respondent Nos.1 and 2 are present in the open Court. Sri D.V.Chalapathi Rao, learned counsel for the petitioner identified petitioner in the open Court. Mr. Pita Raman, learned counsel for the 1st

respondent, identified 1st respondent in the open Court. Ms.Ramya Krishna, Advocate representing Ms. S.Priyanka learned counsel for the 2nd respondent, identified the 2nd respondent in the open Court.

Heard the learned counsel for both the parties and perused the record. This Court read over and explained conditions of the Memorandum of Compromise to the petitioner and respondents in Telugu and they admitted the same. The petitioner and respondents, in the open Court, submitted that they entered into compromise to put an end to the litigation at the advice of the elders.

Accordingly, A.S.M.P.No.3220 of 2017 and ASMP No.3221 of 2017 are allowed. Consequently, both the appeals are disposed of, in terms of the compromise. Miscellaneous petitions, if any, pending in these two appeals shall stand closed.
