THE HONONOURABLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION Nos.4470 and 4479 of 2024 COMMON ORDER:
These Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') seeking regular bail to the petitioners/accused Nos.1 and 2 in Crime No.332 of 2024 on the file of the P.S. Miyapur, Cyberabad, registered for the offences punishable under Section 8(c) read with 20(b)(ii)(B) & 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'NDPS Act').

Heard learned counsel for the petitioners/accused Nos.1 and 2 and learned Additional Public Prosecutor for the respondent State.

Perused the record.

The Inspector of Police, P.S. Miyapur has registered a crime stating that the petitioners/accused Nos.1 and 2 are in possession of 2kgs of ganja. Since the quantity of the contraband seized from the petitioners/accused Nos.1 and 2
is less than the commercial quantity, the relief of regular bail can be granted.

Accordingly, the Criminal Petitions are allowed and the petitioners/accused Nos.1 and 2 shall be released on regular bail subject to the following conditions:
i) The petitioners/accused Nos.1 and 2 shall execute personal bonds for a sum of Rs.50,000/- (Rupees fifty thousand only) each, with two sureties for a like sum each to the satisfaction of learned VIII Additional Metropolitan Magistrate at Kukatpally.
ii) The petitioners/accused Nos.1 and 2 after release, shall appear before the concerned SHO at 10.00 A.M. on every monday, for a period of eight
(08) weeks for the purpose of investigation and thereafter, as and when required.
iii) The petitioners/accused Nos.1 and 2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
Miscellaneous applications, pending if any, shall stand closed.
