THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.38150 OF 2015 O R D E R :

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents.

2. The grievance of the petitioner in this Writ Petition is that the respondents 3 and 4 are not supplying the essential commodities to his fair price shop even though his authorization is subsisting and is valid up to 31.03.2016 and it is neither suspended nor cancelled by the respondents.

3. The learned Government Pleader for Civil Supplies appearing for respondents states that a show cause notice dt.24.11.2015 was issued to the petitioner but the Fair Price Shop authorization of the petitioner has not been suspended as on date.

4. In view of the said submissions, this Writ Petition is disposed of directing the respondents to supply essential commodities to the petitioner's Fair Price Shop since there is no suspension of his authorization as on date. The petitioner shall file a reply to the show cause notice dt.24.11.2015 issued by the 3rd respondent and the 3rd respondent shall conclude the proceedings under Section 6A of the Essential Commodities Act, 1955 against the petitioner within a period of three (03) months from today by following due process of law and principles of natural justice. There shall be no order as to costs.

5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
