THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.43950 OF 2016 ORDER:

This Writ Petition is filed challenging the proceedings in Lr.No.ADE/O/ /F.No. /D.No.513, dated 30.04.2016, a Provisional Assessment Notice, by which, the petitioner was directed to pay Rs.20,19,187/- towards provisionally assessed electricity charges and Rs.1,20,000/- towards compounding fee.

Heard learned counsel for the petitioner and the learned Standing Counsel for the respondents.

During the course of hearing, it is brought to my notice that this Court, in similar circumstances, disposed of W.P.No.38827 of 2016, dated 10.11.2016. It is also stated that the petitioner already paid compounding fee of Rs.1,20,000/-.

In view of the same, the Writ Petition is disposed of, directing the petitioner to deposit an amount of Rs.5,00,000/- (Rupees five lakhs only) within a period of four weeks from today and the respondents are directed to consider the case of petitioner and pass appropriate orders, and if circumstances warrant, consider referring the matter to Special Court for adjudication. Further, on payment of the aforesaid amount, the respondents are directed to restore power connection to the petitioner's service connection. The above exercise shall be completed within a period of twelve (12) weeks from today

and the petitioner shall pay the regular bills. However, the payment shall be subject to final assessment.

Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J December 16, 2016.
