THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9124 of 2016 ORDER:
This Criminal Petition is filed by the petitioners/A-3 & A-4 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.248 of 2013, on the file of Jeedimetla Police Station, Cyberabad, registered for the offences punishable under Sections 417, 420, 376, 323 read with 34 IPC and Section 3(1)(x) of SCs & STs (POA) Act. Heard and perused the material available on record. The allegations against the petitioners are that de facto complainant came into contact with A-1 and that intimacy led to marriage at Yadagirigutta in the year 2012 and both used to have sexual intercourse in the room of A-1 and when she asked A-1 to take her to his house, A-1 insulted her in the name of her caste. On 26.03.2013, A-1 called the de facto complainant to his house and A-1 along with the petitioners scolded her in the name of her caste. The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.
Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence, this Court is of the view that this petition is not maintainable.
