HON'BLE SRI JUSTICE S.V.BHATT W.P.No.17198 OF 2011 ORDER:

Heard Mr.J.U.M.V.Prasad for petitioner, Mr.G.Seshadri for 2nd respondent and Assistant Government Pleader for respondent No.1.

The oral request of Mr.Prasad to implead Guduru Nagar Panchayat as respondent No.6 is accepted and the learned counsel is given liberty to forthwith array Guduru Nagar Panchayat as respondent No.6.

The petitioner complains against inaction of 2nd and 6th respondents in looking into the complaint of petitioner against 5th respondent in encroaching the road in front of the house of 5th respondent as illegal, arbitrary and unconstitutional. The petitioner claims to have represented to respondent No.2 on 13.04.2011 and no action is taken as on date. Having regard to the change of constitution of 2nd respondent from Gram Panchayat to Nagar Panchayat, instead of keeping in the writ petition pending, I consider it appropriate to dispose of the writ petition by this order:

(a) the petitioner is given liberty to represent to 6th respondent by enclosing a copy of this order on the alleged encroachment of road by 5th respondent within four weeks from today.

(b) the 6th respondent thereafter is directed to act on the complaint in accordance with law, afford

opportunity to 5th respondent and take appropriate decision within two months thereafter and communicate to petitioner as well as 5th respondent.

The writ petition is, accordingly, disposed of. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
