0THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.14559 OF 2016 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") for quashing the order dated 22.07.2016 passed in Crl.M.P.No.3004 of 2016 in C.C.No.627 of 2015 on the file of Judicial Magistrate of First Class, Nandyal, Kurnool District by recalling the N.B.W. pending against the petitioner - accused. Medical certificate issued by the Civil Assistant Surgeon, Area Hospital, Suryapet is also filed along with the petition. During hearing Sri P.Vishnuvardhan Reddy, learned counsel for the petitioner, gave an undertaking that the petitioner will appear before the Court subject to recalling of warrant issued against him, for which the learned Public Prosecutor did not oppose.

Taking into consideration of the facts and circumstances of the case and ailment the petitioner suffered on the date of issuing warrant, the order dated 22.07.2016 passed in Crl.M.P.No.3004 of 2016 in C.C.No.627 of 2015 on the file of Judicial Magistrate of First Class, Nandyal, Kurnool District is set aside, recalling the warrant and the petitioner is directed to appear before the Court concerned on the date of adjournment. In the event of failure of the petitioner to appear before the Court on the date fixed for his appearance, the Court can pass appropriate orders.

With the above directions, the petition is disposed of. No costs. The miscellaneous petitions pending, if any, shall also stand closed.
