Heard the learned counsel appearing for the petitioner and the learned Government Pleader for the Civil Supplies (AP).
2. This writ petition is filed seeking Writ of Mandamus declaring the action of the 4th respondent in suspending the authorisation of the petitioner's F.P. Shop at Nallaballe Village, Muddanur Mandal, YSR Kadapa District, vide order dated 26.02.2015, as illegal and arbitrary.
3. The authorisation of the petitioner was suspended by the 4th respondentRevenue Divisional Officer, Jammalamadugu, YSR Kadapa District, vide orders dated 26.02.2015, pending enquiry. The reason for the order of suspension seems to be certain irregularities committed by the petitioner, who is the Fair Price Shop dealer, while distributing the essential commodities to the card holders, basing on the report of the 5th respondent-Tahsildar, Muddanur Mandal. Learned counsel appearing for the petitioner submits that the petitioner submitted her explanation on 19.11.214 stating that she has not violated any conditions of the APSPDS (Control) Order, 2008. He further submits that the 4th respondent without considering the explanation submitted by the petitioner mechanically passed the impugned order suspending the authorisation of the petitioner.
4. Admittedly, the order impugned is passed pending enquiry. In the circumstances, the 4th respondent-Revenue Divisional Officer, Jammalamadugu, YSR Kadapa District, is directed to conduct enquiry against the petitioner and pass final orders, within a period of four weeks from the date of receipt of a copy of this order.
5. The writ petition is accordingly disposed of. Miscellaneous applications, if
