THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE TODUPUNURI AMARNATH GOUD WRI T PETI TI ON No. 32126 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) By way of this writ petition, the petitioner seeks a writ of certiorari to call for the records pertaining to C.C.No.349 of 2017 on the file of the District Consumer Redressal Forum - III at Hyderabad and declare the action of the said Forum in not even assigning an I.A. number, though S.R No.998 of 2017 was assigned, to the application for grant of interim order pending disposal of the Consumer Case, as illegal and arbitrary.
We are of the opinion that a writ of this nature cannot be entertained for directing a statutory body to discharge its function. In the event the petitioner is aggrieved by any delay on the part of the statutory body in numbering and taking up an application, it is for him to make a mention before the said body or move an advancement petition.
The writ petition is therefore misconceived and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
