HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 13787 of 2002 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 24.01.2000 of the 1st respondent and the consequential proceedings of the 3rd respondent dated 16.02.2000 refusing to pay the graduate increments and directing to recover the graduate increments already paid to the petitioners, as illegal and arbitrary.
None appears for the petitioners. Heard Sri P. Durga Prasad, learned standing counsel for the respondent corporation. The record discloses that as per the proceedings dated 22.10.1999 of the 1st respondent, graduate increments can be continued to those who were appointed as Junior Assistants from the rank of Conductors prior to 01.04.1989. Since all the petitioners were appointed prior to 1989, they are entitled for graduation increments. In view of the above, the writ petition is disposed of with a direction to the respondents to grant graduation increments to the petitioners.
