THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 8273 of 2017 ORDER:
This writ petition was filed for the following relief: "To issue a writ, order or direction more particularly, one in the nature of writ of mandamus declaring the action of respondent No.2 in not providing police protection to the petitioners in respect of agricultural land in Survey No.148, total extent Acs.14.09 guntas situated at Chinaelikcherla Village, Kondurg Mandal, Mahaboobnagar District (old), Ranga Reddy District (new) is highly illegal, arbitrary and against the principles of natural justice and consequently direct respondent No.2 herein to provide police protection to the petitioners to safeguard the possession of the petitioners in respect of agricultural land in Survey No.148, total extent of Acs.14.09 guntas situated at Chinaelikcherla Village, Kondurg Mandal, Mahaboobnagar District (old), Ranga Reddy District (new), otherwise the petitioners will be deprived of their legitimate rights and possession over the agricultural land and suffer irreparable loss and injury."
Today, when the matter is taken up for consideration, learned Government Pleader for Home, on the basis of written instructions, submits that the complaint, dated 27.02.2017, was not received by respondent No.2-Station House Officer, PS Kondurg, Ranga Reddy District and the present writ petition was filed without approaching respondent No.2. He further submits that if the petitioners approach respondent No.2 and file a complaint, appropriate action will be taken thereon as per law.
In view of the above, liberty is given to the petitioners to approach respondent No.2 and file a complaint with regard to their
grievance and on receipt of the same, respondent No.2 shall take appropriate action in accordance with law.
The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:22.03.2017 kdl
