HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 31760 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 91 of Malkapur Village, Nizamabad Mandal and District. It appears that on 16.5.2015 the Assistant Supply Officer along with his staff inspected the fair

price shop of the petitioner and found variations in the stock. He submitted a report to the third respondent, who based on the same, issued a show cause notice on 18.5.2015 alleging as many as six irregularities against the petitioner. The petitioner submitted her explanation on 25.3.2015 denying the allegations levelled against her. Being not satisfied with her explanation, the third respondent suspended the authorization of the petitioner by order dated 25.5.2015 pending enquiry. Challenging the same, the present Writ Petition is filed.

This Court has carefully gone through the allegations levelled against the petitioner and is prima facie of the opinion that the said allegations require to be enquired into and enquiry initiated against the petitioner is pending. In those circumstances this Court is not inclined to interfere with the enquiry process at this stage. In view of the suspension of authorization of the petitioner pending enquiry, the third respondent is directed to complete the enquiry and pass appropriate orders within a period of thirty days from the date of receipt of a copy of this order by giving due opportunity to the petitioner and observing principles of natural justice during the enquiry process. Subject to the above, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence.
