Najeeb Ulla Gouri v. State Of Telangana
THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.3194 OF 2018 ORDER:
This petition is filed by the petitioners-A1 and A2 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.52 of 2018 on the file of the Station House Officer, Rein Bazar P.S., Hyderabad, registered for the offences punishable under Sections 341, 323 and 506 IPC.
2.
Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.
3.
Learned counsel for the petitioners would submit that due to dispute between parties to the litigation, a false report was lodged with the police. There are interpolations in the report.
4.
As per the record, the offences alleged against the petitioners are bailable. It has been urged before this Court that the S.H.O. concerned has not been granting bail to the petitioners. The petitioners are apprehending arrest and remand to judicial custody. As seen from the material, there are specific allegations, which require investigation. It is not appropriate to quash the proceedings. However, the interest of the petitioners is required to be protected. 5.
Since the offences alleged against the petitioners are bailable, the Station House Officer/Investigating Officer is directed to release the petitioners-A1 and A2 on bail, on each of them executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with two sureties in a like sum each to his satisfaction.
6.
With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
