THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.20912 OF 2014 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents 1 to 3.

The prayer sought in the Writ Petition is as under:- "...to issue an appropriate Writ, Order or Direction, more particularly one in the nature of writ of Mandamus, to declare the 3rd respondent in not proceeding with the investigation into Cr.No.60/2013 though the said crime is registered on 14.03.2013, in spite of repeated visits made by the petitioner as being illegal, arbitrary and unjust and consequently direct the 2nd respondent to take action against the 3rd respondent for his dereliction of duties, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

During the course of hearing, the learned Government Pleader brought to the notice of this Court that pursuant to registration of Crime No.60 of 2013 for the offences punishable under Section 3(1)(x) of the SCs & STs (POA) Act and Sections 323 and 506 read with Section 34 of the Indian Penal Code, investigation was completed and the same was referred as "false". Pursuant to filing their final report, a notice was also sent to the complainant i.e. the petitioner herein. In view of the same, if the petitioner is aggrieved by the final report, the remedy lies before the concerned Magistrate.

Therefore, the Writ Petition is dismissed.
