THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33050 OF 2015 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed for the following relief:

"to issue a writ of mandamus or any other appropriate writ, order or direction declaring the action of the respondents 2 to 4 in permitting the 6th respondent to shift its A4 shop G.No.223 from 3rd and 12th divisions to 26th Division of Tirupathi in spite of prohibition for establishment of liquor shop at Division No.26 of Tirupathi, Chittoor District, A.P., as illegal, arbitrary exercise of power and violative of Article 21 of the Constitution of India and consequently direct the respondents not to permit to establish liquor shop either at Division No.26 of Tirupathi."

2. Heard Sri K.Chidambaram, learned counsel for the petitioners and learned Government Pleader for Prohibition and Excise for respondents 1 to 5.

3. During course of hearing, it is brought to the notice of this Court, the grievance of the petitioners is that they submitted a representation on 14.09.2015 to the Commissioner of Prohibition and Excise, Andhra Pradesh, Hyderabad-2nd respondent herein.

4. Learned counsel for the petitioners requested this Court to direct the 2nd respondent to take appropriate action on the said representation.

5. In view of above submission, the writ petition stands disposed of, without expressing any opinion on merits, directing the 2nd respondent-Commissioner of Prohibition and Excise, Andhra Pradesh, Hyderabad, to take appropriate action on the representation, dated 14.09.2015, said to have been submitted by the petitioners

along with others and take action in accordance with law within a period of ten (10) days from the date of receipt of a copy of this order. There shall be no order as to costs.
