THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 18926 of 2016 ORDER:

The present Writ Petition is filed with the following prayer: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that the Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondent No.2 in interfering with the petitioner's peaceful possession and enjoyment of the residential plot to an extent of Ac.0.10 1⁄2 cents out of Ac.1.30 cents situated in Survey No.178-1 within the limits of Anantapuramu Municipal Corporation without issuing notice and without following due process of law as illegal, arbitrary and consequently direct respondent No.2 not to interfere with the petitioner's peaceful possession and enjoyment of the residential plot to an extent of Ac.0.10 1⁄2 cents out of Ac.1.30 cents situated in Survey No.

178-1 within the limits of Anantapuramu Municipal Corporation in the interest of justice and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstance of the case.' Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents not to dispossess him, without following due process of law. Learned Standing Counsel for respondent No.2 submits that any action taken can only be in accordance with law. Having regard to the submissions made, the writ petition is disposed of directing respondent No.2 to follow due process of law before taking any steps of dispossession in respect of the property in dispute.

Miscellaneous petitions, pending if any, shall stand closed in
