This Writ Petition is filed to declare the action of the respondents in insisting the petitioner to pay the EMD for the civil contractor works as illegal and arbitrary and contrary to G.O.Ms.No.52, TR&B Department, dated 18.03.2000.

When the matter is taken up for hearing today, it is represented by the learned counsel for the petitioner that nothing survives for adjudication in the Writ Petition and the matter has become infructuous. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
