THE HON'BLE THE CHIEF JUSTICE RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE DR. SHAMEEM AKTHER Writ Appeal No.459 of 2019 ORDER: (Per the Hon'ble the Chief Justice Raghvendra Singh Chauhan) The appellants have challenged the legality of the order dated 01.03.2019 passed by a learned Single Judge in I.A. No. 3 of 2018 in W.P. No. 86 of 2018, whereby the learned Single Judge had modified the earlier interim order and directed that "the impleaded respondents may be given promotion as Section Officers, but the said promotion shall be subject to the result of the writ petition". The learned counsel for the appellants submits that while giving the promotion, the respondents are likely not to observe the quota rules. Therefore, the promotion given, even on an ad hoc basis, would be violative of the quota rules.
On the other hand, the learned counsel for the respondents submits that the learned Single Judge had already clarified that "any promotion given in the interim period would be subject to the result of the writ petition". Therefore, the apprehension of the appellants is highly misplaced.
Once the learned Single Judge had clarified that the promotion would be subject to the result of the writ
petition, the apprehension entertained by the appellant is unjustified. However, considering the fact that the writ petition is still pending before the learned Single Judge, considering the fact that the controversy with regard to the promotion to be given needs to be settled as soon as possible, this Court requests the learned Single Judge to decide the writ petition within a period of two months from today.
With this direction, the writ appeal stands disposed of.
Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
