Appeal Suit No.105 of 2005 was dismissed for default on 4.11.2015 by the IX-Additional District Judge, Machilipatnam, Krishna District. The present Civil Revision Petition was filed on 26.8.2015 i.e., three months prior to dismissal of the Appeal Suit. Hence, the present Civil Revision Petition becomes infructuous and, accordingly, dismissed as infructuous leaving it open to the petitioner to recall the impugned order in case Appeal Suit is restored.
