Bijay Singh S/O. Late Gyani Avatar Singh v. State Of Telangana
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.32612 of 2015 ORDER:
The petitioners state that the land admeasuring Ac.3-20 gts., in Sy.No.27/AA situated at Guttala Begumpet Village, Serilingampally Mandal, Ranga Reddy District, which was previously recorded in the name of one Kummari Rajaiah has since been mutated in the names of Gyani Avtar Singh, an extent of Ac.1-20 gts., Kamalamma Boppana an extent of Ac.1-00 gts., Meruva Ramalaxmamma an extent of Ac.0-20 gts, and Puppala Siva Kumar an extent of Ac.0-20 gts. The petitioners state that Gyani Avtar Singh died and his son appears as the 1st petitioner. All the four petitioners contend that though their names were mutated in the revenue records, the 3rd respondent is trying to interfere with their possession. Hence, the petitioners filed the present writ petition seeking a Mandamus. Learned Government Pleader for Revenue, on instructions, fairly stated that the respondents have already recognized the entitlement of the petitioners and accordingly granted mutation by the 3rd respondent vide proceedings No.B/156/2015, dated 23-09-2015 and as such, there is no interference by the revenue authorities.
In view of the said categorical statement that there is no interference by the revenue authorities and as the mutation is already granted in favour of the petitioners, as per the aforesaid order, the apprehension of the petitioners, as expressed in the writ petition, is clearly misplaced and as such, no further orders are called for.
Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 06-10-2015
