This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ, order or directions more in the nature of Writ of Mandamus to declare the action of the respondents 1 and 2 in according approval to the 4th respondent society to commence the 3rd respondent institution under the name "SHIVA SHIVANI INSTITUTE OF MANAGEMENT SCIENCES" without directing the 4th respondent to adopt a district name from that of the 2nd petitioner's institution as illegal, arbitrary, unconstitutional and in violation of duties assigned to it under the provisions of AICTE Act, 1987 and direct the respondents 1 and 2 to forthwith withdraw recognition granted to the respondents 3 and 4."
Heard, Sri S. Niranjan Reddy, learned counsel for the petitioners and Sri K. Ramakanth Reddy, learned Standing Counsel for the respondents 1 and 2. Despite service of notice none appears for respondents 3 and 4.
Learned counsel for the petitioners submits that the petitioners herein submitted a representation on 07-06-2010 to the respondents 1 and 2 and so far no action has been taken by the respondents 1 and 2 on the said representation in the direction of redressal of the grievance of the petitioners.
On the other hand, it is submitted by learned Standing Counsel for respondents 1 and 2 that the issue in the present Writ Petition is purely a civil dispute between petitioners and respondents 3 and 4 and the Writ Petition cannot be maintained.
Learned counsel for the petitioners requested this Court to permit the petitioners herein to make representation before the respondents 1 and 2 for redressal of their grievance and the same may be directed to be considered, in accordance with law.
Recording the said submission, the Writ Petition is disposed of, permitting the petitioners to submit a representation to the respondents 1 and 2 for redressal of their grievance within a period of one month from the date of receipt of a copy of this order and if any such representation is made same be considered and appropriate orders be passed, in accordance with law, within a period of three (3) months thereafter. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
