ORDER:

This company petition is filed for an order to wind up the respondent company for non-payment of the debts allegedly due to the petitioner. On behalf of the respondent, its Managing Director - Mr.C.V.R.Chowdary, filed his sworn affidavit, 05.10.2015, whereby the respondent has agreed to pay Rs.50,23,400/- (Rupees fifty lakhs twenty three thousand and four hundred only), which includes registration charges of Rs.2,44,275/-, to the petitioner. In paragraph 4 of the said affidavit, the respondent has indicated the payment schedule and it reads as under:

"The respondent hereby submits that a sum of Rs.5.00 lakhs is paid vide D.D.No.501072, dated 09.09.2015 drawn by ICICI Bank favouring the petitioner. The balance amount of Rs.45,23,400/- would be paid @ Rs.3.00 lakhs per month commencing from October, 2015 in 14 installments and an amount of Rs.3,23,400/- as 15th installments, the respondent will pay Rs.3,23,400/-."

Mr.V.S.Raju, learned counsel for the petitioner, submitted that in view of the aforementioned affidavit filed by the Managing Director of the respondent, the company petition may be closed by taking on record the said affidavit.
