HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2572 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners/Accused Nos.1 to 3 , on bail in connection with Crime No.20 of 2022 on the file of Kukunoorpally Police Station, Siddipet District registered for the offences punishable under Sections 370 and 370(A) of Indian Penal Code and Sections 3, 4 and 5 of Prevention of Immoral Traffic Act, 1956. 2.

Heard Sri M.A.K.Mukheed, learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

Briefly the facts of the case are that on 12.02.2022 the police personnel having received some information about organized prostitution, registered a case in crime No.20 of 2022 for the offences punishable under Sections 370 and 370(A) of Indian Penal Code and Sections 3, 4 and 5 of Prevention of Immoral Traffic Act, 1956. Thereafter having secured panchas and search warrant issued by Assistant Commissioner of Police raided the premises at

House No.5-90/1 of Accused No.1, where it was found that petitioner/Accused No.1 was running prostitution in his residence and petitioners/Accused Nos.2 and 3 were assisting him. Accused Nos.4 to 6 were also found in the said premises who are customers and who have been released on bail by the lower Court. The police conducted seizures and also identified victims LWs 8 to 12 who are all majors.

Learned Assistant Public Prosecutor submits that two other cases are pending against petitioner/Accused No.1. 5.

The petitioners are arrayed as Accused Nos.1 to 3 in the aforementioned crime, other than the confession of Accused No.1 regarding involvement of petitioners/Accused Nos.2 and 3 as assistants to the petitioner/Accused No.1, there are no allegations of procuring women/girls or forcing them into prostitution. For the said reason, this court is inclined to grant bail for petitioners/Accused Nos.2 and 3, on certain terms and conditions: i) The petitioners/Accused Nos.2 and 3 are directed to be released on bail on their executing a personal bond for Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for likesum

each to the satisfaction of Additional Judicial First Class Magistrate at Gajwel.

ii) The petitioners/Accused Nos.2 and 3 shall appear before the Station House Officer, Kukunoorpally Police Station for a period of twelve (12) weeks, on every Wednesday and Sunday between 10.00 A.M to 12.00 Noon.

Accordingly, the Criminal Petition for petitioner/Accused No.1 is dismissed and allowed for petitioners/Accused Nos.2 and 3. 7.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
