THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.8401 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Civil Supplies appearing for respondents. Non-disposal of the appeal dated 28.10.2017 by the Joint Collector, Kurnool District, filed by the petitioner against the Orders of the 3rd respondent dated 11.10.2017 is under challenge in the present writ petition. According to the petitioner, he was appointed as Fair Price Shop Dealer of Ponnapuram Village, Nandyal Mandal of Kurnool District, on permanent basis vide proceedings D.Dis.(A)/1147/2008, dated 31.05.2008 passed by the Revenue Divisional Officer, Nandyal. By way of an Order dated 11.10.2017, the Revenue Divisional Officer, Nandyal, suspended the Fair Price Shop authorization of the petitioner herein.

According to the learned Counsel appearing for the petitioner, though the petitioner herein filed appeal against the order as long back as on 28.10.2017, so also an application seeking stay of operation of the Orders passed by the Revenue Divisional Officer, no order have been passed by the Joint Collector either on the stay application or in the main appeal.

Having heard the learned Counsel appearing for the petitioner and also the learned Government Pleader, and

keeping in view of the nature of the controversy, this Court deems it proper to dispose of the writ petition directing the respondent No.2/Joint Colector, Kurnool, to pass appropriate Orders on the appeal dated 28.10.2017 filed by the petitioner on the Orders of the Revenue Divisional Officer, dated 11.10.2017 within a period of four weeks from the date of receipt of a copy of this Order.

The writ petition is disposed of accordingly. No order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
