HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.9533 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for respondents 1 to 5. This Writ Petition is filed seeking to declare the action of the respondents in not providing HT connection (HT Category-VI) to the petitioner's villa Nos.1 & 2, situated at Aparna Orchid, Hi-tex, Kondapur, Hyderabad, as arbitrary and illegal. Petitioner is the owner of Villa Nos.1 and 2, situated at Aparna Orchids, Hi-Tex, Kondapur, Hyderabad and the said Villas got LT service connections bearing Nos.110660073 & 1106600732. Out of 59 residents of the colony, only 57 members opted for HT supply (HT Category-VI) and the petitioner was using the LT services since 2012.

While LT services were converted to HT services to 57 Villas in the colony, the LT connections in the Villas of the petitioner were removed without any notice on 13.4.2013 and his family faced lot of inconvenience for three days without power supply. The respondents restored the power supply from a nearby transformer, for which, the local villagers protested for the same. The Aparna Orchid community is a gated community and has got an association namely Aparna Orchids Owners Welfare Association. There were disputes between the petitioner and the association as he questioned the misdeeds of the society and filed some criminal cases and other cases against the society. Therefore, the society excluded the HT connection to Villas of the petitioner.

Because of the hardship and inconvenience of LT connection power supply, the petitioner made a complaint before the Consumer Grievances Redressal Forum of APCPDCL.

Forum opined that the respondents are at fault and warned them not to repeat the same mistake in future vide proceedings dated 6.5.2013. Thereafter, the petitioner carried the matter to Vidyut Ombudsman by filing Appeal No.88 of 2013 and the Vidyut Ombudsman vide order dated 22.01.2014 observed that the petitioner is at liberty to file a claim for compensation as he was aggrieved by the illegal cut of LT connection to his Villas. Pursuant to the same, the petitioner made several representations to the respondent-authorities to provide HT Service Connection to his Villas as the temporary LT connection is causing lot of problems and the latest representation is dated 24.5.2014. Learned counsel appearing for the petitioner submits that though the petitioner made representation on 24.5.

2014, no action has been taken thereon by the respondents so far. Under these circumstances, the Writ Petition is disposed of directing the respondents to consider the representation dated 24.5.2014 made by the petitioner, whereunder he sought HT service connection and dispose of the same, within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
