THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.1171 OF 2016 ORDER:
This Contempt Case was instituted alleging willful disobedience to the order dated 25.11.2015 passed in W.P.No.29894 of 2015. By the said order, the appellate order dated 31.8.2015 was set aside and the matter was remitted to the appellate authority, viz., Commissioner of Prohibition and Excise, State of Telangana, to consider the matter afresh in terms of the directions of this Court in W.P.No.11788 of 2015 and pass appropriate reasoned orders in the matter in accordance with law. Asserting that no such exercise was undertaken, this Contempt Case was instituted. The Commissioner of Prohibition and Excise, State of Telangana, Hyderabad filed a counter affidavit stating that after receipt of the aforestated order, the matter was taken up for hearing by him on 21.12.2015 and the appeal was once again rejected by way of a reasoned order on 29.12.2015. The Commissioner further stated that Writ Petition No.3933 of 2016 was then preferred by the petitioner aggrieved by the aforestated appellate order.
In the light of the aforestated facts, this Court finds no disobedience, much less willful disobedience, warranting exercise of contempt jurisdiction. The Contempt Case is accordingly dismissed. No order as to costs. ----------------------- SANJAY KUMAR, J.
