THE HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI CRIMINAL PETITION No.2672 of 2019 ORDER:
The petitioners are accused Nos.1, 3 and 6 in Crime No.7B of 2019 on the file of Central Crime Station, Hyderabad District, registered for the offences under Sections 406 and 420 IPC read with Section 34 lPC. By way of this petition filed under Section 438 Cr.P.C., the petitioners seek grant of anticipatory bail. The petitioners contended that they have been falsely implicated in the above said crime. They further contended that they have invited applications for appointment of dealers for supply of diesel and later on, in spite of accepting the monies from the proposed dealers, they have not appointed the dealers. They also contended that the allegations in the FIR are civil in nature and the investigating authorities are threatening to arrest them.
Learned counsel for the petitioners contended that the petitioners are law abiding citizens and they will cooperate with the investigating authorities as and when required, provided they are granted anticipatory bail with certain conditions. The Assistant Public Prosecutor contended that ten witnesses have been examined and the investigation is under progress. Having considered the respective submissions, this Court is of the opinion that the petitioners can be granted anticipatory bail on conditions.
, The Criminal Petition is accordingly allowed. ln the event of arrest of the petitioners-accused Nos.1, 3 and 6 in Crime No.78 of 2019 on the file of Central Crime Station, Hyderabad District, they I
shall be released on bail upon their furnishing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) each with two sureties for a like sum each to the satisfaction of the Police, WCO Team Xl, CCS, DD, Hyderabad District. They shall also report before the said Police on every Sunday between 9.00 a.m. and 10.00 a.m. until filing of the final reporUcharge sheet.
