HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9006 of 2016 O R D E R:

This petition is filed by the petitioners-accused Nos.1 & 2 under Sections 437 and 439 of the Criminal Procedure Code seeking to grant bail to them in Crime No.48 of 2016 on the file of Shayampet Police Station, Warangal District, registered for the offence punishable under Sections 307 r/w 34 IPC.

It is alleged that the complainant was having illicit intimacy with the wife of A2. A2 found the same. On 23.5.2016, while the deceased (wife of the complainant) was sleeping, A1 and A2 trespassed into the courtyard of the deceased, A2 caught hold of the deceased, closed her mouth and A1 stabbed her.

Learned Counsel for the petitioners submitted that the petitioners were falsely implicated in the above crime and that the petitioners were arrested on 26.5.2016 and since then, they have been in prison.

Learned Additional Public Prosecutor opposed this petition and submitted that the investigation has not yet been completed. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners at this stage.
