These petitions coming on for hearing, upon perusing the Petitions and the grounds filed in support thereof and upon hearing the arguments of Sri K SRINIVASA REDDY, Advocate for the Petitioner in both petitions, and of Assistant Public Prosecutor for the respondent in both petitions, the Court made the fo llowin g.
ORDER
THE HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI CRIMINAL PETITION Nos.2674 and 2675 of 2019 COMMON ORDER:
The petitioners are accused Nos.2 and 4 in Crime No.62 of 2019 on the file of Thallada Police Station, Khammam District registered for the offences under Sections 406, 403, and 420 l.P.C. By way of these petitions filed under Section 438 Cr.P.C., the petitioners seek grant of anticipatory bail.
The petitioners contended that they have been falsely implicated in the above said crime and they are no way related with the cold storage. They further contended that at the instance of the de-facto complainant-lDBl Bank Limited, a false case has been registered against them and the investigating authorities are taking steps to arrest them.
Learned counsel for the petitioners contended that the petitioners hail from respectable families and they are law abiding citizens and they will cooperate with the investigating authorities as and when required, provided they are granted anticipatory bail with certain conditions.
The Assistant Public Prosecutor contended that seven witnesses haver been examined and the investigation is under progress.
Having considered the respective submissions, this Court is of the opinion that the petitioners can be granted anticipatory bail on cond itions.
The Criminal Petitions are accordingly allowed. ln the event of arrest of the petitioners-accused Nos.2 and 4 in Crime No.62 of 2019 on the file of Thallada Police Station, Khammam District, they shall be released on bail upon their furnishing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) each with two sureties for a like sum each to the satisfaction of the Station House Officer, Thallada Police Station, Khammam District. They shall also report before the Thallada Police Station, Khammam District, on the first day of every month between 9.00 a.m. and 10.00 a.m. until filing of the final reporVcharge sheet.
