HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30067 of 2015 ORDER:

This Writ Petition is filed assailing the action of the 4th respondent in initiating proceedings dated 18.04.2015 under Act 9 of 1977 against petitioner's land to an extent of Acs.2.16 cents in Sy.No.382/C3 of Chengiskhanpet, H/o.Kondaveedu Village, Edlapadu Mandal, Guntur District as illegal and arbitrary and consequently, to set aside the same.

Heard learned counsel for the petitioner, who submits that the lis in this Writ Petition is squarely covered by the orders of this Court in WP No.24185 of 2013 dated 06.09.2013, wherein this Court allowed the Writ Petition granting mandamus to the 4th respondent therein to issue pattadar pass books and title deeds to the petitioners in respect of the subject property in the said Writ Petition.

The aforesaid submission of the learned counsel for the petitioner is not disputed by the learned Assistant Government Pleader for Revenue appearing for respondents. In view of above facts and circumstances, the impugned order passed by the 4th respondent dated 18.04.2015 is liable to be set aside and accordingly set aside.

Accordingly, this Writ Petition is allowed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in these Writ Petitions, shall stand closed.
