THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.3178 OF 2018 ORDER:

This petition is filed by the petitioner-A4 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.47 of 2018 on the file of the Station House Officer, Chapadu P.S., Kadapa District, registered for the offences punishable under Sections 420 IPC and 7 (1) of Essential Commodities Act.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that the petitioner has nothing to do with the alleged seizure of PDS rice said to have been transported by A1 to A3. The allegation that this petitioner was about to purchase PDS rice is absolutely false.

The subject PDS rice was seized in the course of transportation. In the confession of the other accused, this petitioner is made an accused in this case. Investigation has to go on to find out the truth or otherwise of the allegations. The interest of the petitioner-A4 is required to be protected. 5.

Under these circumstances, the Station House Officer/Investigating Officer is directed to complete the investigation and file final report, without arresting the petitionerA4 in the above crime. The petitioner-A4 shall co-operate with the investigating officer.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
