THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6293 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioner/A-2 seeking to quash the proceedings in F.O.No.1/2016-17 of Chelama Range, Kurnool District.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioner are punishable under Sections 9, 27 and 49(A) read with 51 of the Wild Life Protection Act, 1972.

4. After arguing for sometime, learned counsel for the petitioner while not pressing for the main prayer, confined his arguments only to the extent of ordering interim custody of the tractor bearing registration No.AP 21 BB 7632 seized in connection with the aforementioned crime.

5. Considering the facts and circumstances of the case, the petitioner is directed to file an affidavit before the Court concerned for return of the vehicle in question and on such application, the learned Magistrate shall pass appropriate orders in accordance with law.
