THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 24074 of 2017 ORAL ORDER: (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, petitioner has assailed order dated 01.03.2016 passed in O.A.No.662 of 2016 whereby the Andhra Pradesh Administrative Tribunal, Hyderabad, passed the order as under: "Therefore, for all the above reasons, the original application is dismissed insofar as relief of questioning of charge memo is concerned, but, however, directing the respondents 1 and 2 to sanction and release leave encashment to the applicant, on his attaining of age of superannuation and retirement, within a period of two months from the date of receipt of copy of this order, if not already sanctioned."

Learned Government Pleader for Prohibition & Excise (A.P.) appearing on behalf of the respondents has filed Memo No.52227/Vig.IV(2)/2012 dated 18.12.2017 whereby stated that cases are booked by Anti-Corruption Bureau in the scam in all the Districts of both the States of Andhra Pradesh and Telangana. Oral evidence as well as documentary evidence in enquiries, relating to the scam including the present case is voluminous. Hence, the Government Pleader seeks six months time to complete the enquiry in this case. 3.

Keeping in view the facts and circumstances of the case and the allegations of the petitioner, we hereby direct the respondents to complete the enquiry within a period of six (6) months from today. It is needless to say that the respondents shall comply with the direction given by the learned

Tribunal i.e., respondent Nos.1 and 2 shall sanction and release leave encashment to the petitioner, as he already attained the age of superannuation in the year 2013. The writ petition is accordingly disposed of.
